Freedom! Lakota Sioux Indians Declare Sovereign Nation Status
Threaten Land Liens, Contested Real Estate Over Five State Area in U.S.West Dakota Territory Reverts back to Lakota Control According to U.S., International Law

WASHINGTON, DC - December 20 - Lakota Sioux Indian representatives declared sovereign nation status today in Washington D.C. following Monday's withdrawal from all previously signed treaties with the United States Government. The withdrawal, hand delivered to Daniel Turner, Deputy Director of Public Liaison at the State Department, immediately and irrevocably ends all agreements between the Lakota Sioux Nation of Indians and the United States Government outlined in the 1851 and 1868 Treaties at Fort Laramie Wyoming.


"This is an historic day for our Lakota people," declared Russell Means, Itacan of Lakota. "United States colonial rule is at its end!"

"Today is a historic day and our forefathers speak through us. Our Forefathers made the treaties in good faith with the sacred Canupa and with the knowledge of the Great Spirit," shared Garry Rowland from Wounded Knee. "They never honored the treaties, that's the reason we are here today."

The four member Lakota delegation traveled to Washington D.C. culminating years of internal discussion among treaty representatives of the various Lakota communities. Delegation members included well known activist and actor Russell Means, Women of All Red Nations (WARN) founder Phyllis Young, Oglala Lakota Strong Heart Society leader Duane Martin Sr., and Garry Rowland, Leader Chief Big Foot Riders. Means, Rowland, Martin Sr. were all members of the 1973 Wounded Knee takeover.

"In order to stop the continuous taking of our resources – people, land, water and children- we have no choice but to claim our own destiny," said Phyllis Young, a former Indigenous representative to the United Nations and representative from Standing Rock.

Property ownership in the five state area of Lakota now takes center stage. Parts of North and South Dakota, Nebraska, Wyoming and Montana have been illegally homesteaded for years despite knowledge of Lakota as predecessor sovereign [historic owner]. Lakota representatives say if the United States does not enter into immediate diplomatic negotiations, liens will be filed on real estate transactions in the five state region, clouding title over literally thousands of square miles of land and property.

Young added, "The actions of Lakota are not intended to embarrass the United States but to simply save the lives of our people".

Following Monday's withdrawal at the State Department, the four Lakota Itacan representatives have been meeting with foreign embassy officials in order to hasten their official return to the Family of Nations.

Lakota's efforts are gaining traction as Bolivia, home to Indigenous President Evo Morales, shared they are "very, very interested in the Lakota case" while Venezuela received the Lakota delegation with "respect and solidarity."

"Our meetings have been fruitful and we hope to work with these countries for better relations," explained Garry Rowland. "As a nation, we have equal status within the national community."

Education, energy and justice now take top priority in emerging Lakota. "Cultural immersion education is crucial as a next step to protect our language, culture and sovereignty," said Means. "Energy independence using solar, wind, geothermal, and sugar beets enables Lakota to protect our freedom and provide electricity and heating to our people."

The Lakota reservations are among the most impoverished areas in North America, a shameful legacy of broken treaties and apartheid policies. Lakota has the highest death rate in the United States and Lakota men have the lowest life expectancy of any nation on earth, excluding AIDS, at approximately 44 years. Lakota infant mortality rate is five times the United States average and teen suicide rates 150% more than national average. 97% of Lakota people live below the poverty line and unemployment hovers near 85%.

"After 150 years of colonial enforcement, when you back people into a corner there is only one alternative," emphasized Duane Martin Sr. "The only alternative is to bring freedom into its existence by taking it back to the love of freedom, to our lifeway."

We are the freedom loving Lakota from the Sioux Indian reservations of Nebraska, North Dakota, South Dakota and Montana who have traveled to Washington DC to withdraw from the constitutionally mandated treaties to become a free and independent country. Reports circulating in the Kremlin today state that an enraged President Putin has ordered Russian Foreign Ministry Officials to begin the processes needed for Russia to recognize the Lakota Sioux Indian Tribe as an independent Nation, and who have now broken away from the United States by renouncing their treaties with their occupiers, and as we can read as reported by the AFP News Service:
"The Lakota Indians, who gave the world legendary warriors Sitting Bull[pictured left] and Crazy Horse, have withdrawn from treaties with the United States, leaders said Wednesday.
"We are no longer citizens of the United States of America and all those who live in the five-state area that encompasses our country are free to join us," long-time Indian rights activist Russell Means told a handful of reporters and a delegation from the Bolivian embassy, gathered in a church in a run-down neighborhood of Washington for a news conference.
A delegation of Lakota leaders delivered a message to the State Department on Monday, announcing they were unilaterally withdrawing from treaties they signed with the federal government of the United States, some of them more than 150 years old.
They also visited the Bolivian, Chilean, South African and Venezuelan embassies, and will continue on their diplomatic mission and take it overseas in the coming weeks and months, they told the news conference.
Lakota country includes parts of the states of Nebraska, South Dakota, North Dakota, Montana and Wyoming.
The new country would issue its own passports and driving licences, and living there would be tax-free — provided residents renounce their US citizenship, Means said.
The treaties signed with the United States are merely "worthless words on worthless paper," the Lakota freedom activists say on their website.
The treaties have been "repeatedly violated in order to steal our culture, our land and our ability to maintain our way of life," the reborn freedom movement says.
Withdrawing from the treaties was entirely legal, Means said.
"This is according to the laws of the United States, specifically article six of the constitution," which states that treaties are the supreme law of the land, he said.
"It is also within the laws on treaties passed at the Vienna Convention and put into effect by the US and the rest of the international community in 1980. We are legally within our rights to be free and independent," said Means."
Putin's anger, according to these reports, is based upon the United States engineering of the failure of United Nations talks on the Serbian breakaway province of Kosovo which is seeking independence, and which, according to Russian experts, will lead to an 'uncontrollable crisis' throughout the Balkans.
Putin was reported to have told one of his top aides that 'two can play at this game', in an obvious reference to the American President whom President Putin blames as being behind the machinations to increase instability along Russia's borders with Eastern Europe.
Russian legal experts further state that of all of the United States Indian Tribes, the Lakota Sioux are the best positioned to have their declaration of independence from the American government recognized by the United Nations as they remain the only indigenous peoples in the US to have refused to accept payment for their lands, estimated to be nearly $1 billion, which they consider their 'sacred grounds' and have stated they would never relinquish.
It is, also, interesting to note that the Lakota Sioux are credited with one of the American Indians greatest defeat of US Military Forces in the Indian Wars by defeating the US Civil War Hero George Armstrong Custer and his Seventh Calvary in June, 1876 at the battle of Little Big Horn.
With these latest events, and with Russia as a potential new ally, one can only wonder if these long suffering and resilient Indians can once again defeat their age old enemies residing in the corridors of power in Washington D.C.

MNN. Dec. 25, 2007. The times, they are achangin’. Go to the

www.lakotafreedom.com website. There you’ll see Canupa Gluha

Mani of the Strong Heart Warrior Society of the Lakota Nation cutting

up his colonial driver’s license. He’s doing this because on December

17th 2007 the Lakota delivered their “Declaration of Continuing

Independence”, just in time for the Winter Solstice.



The history of Lakota with the U.S. is long, complex and tragic. They

knew something had to change. After the Wounded Knee Occupation

of 1973, the International Indian Treaty Council was established. From

June 8 to 16 1974 the Council called for a “Western Hemisphere”

Conference at Standing Rock Sioux. Over 5000 delegates of 97

Indigenous Peoples from the Americas gathered. The “manifesto”

that was created on that occasion supports the rights of all Indigenous

Peoples to live free and take whatever actions are necessary to uphold

our sovereignty.



It is rumored that President of Russia, Vladimir Putin, a powerful world

leader, said today that he is considering recognizing the Lakota as an i

ndependent nation. Withdrawing from the treaties is entirely legal. It is

within the laws on treaties passed at the Vienna Convention and put

into effect by the U.S. and the rest of the international community in 1980.



The Lakota never relinquished their lands and have always refused

to accept payment estimated close to $1 billion to give up their

sovereignty and nationhood. Offering to buy us out means they are

acknowledging our sovereignty.



They declared the obvious. The lands belong to the various Indigenous

peoples and are clearly defined by the treaties. Where there are no

treaties, the U.S. and Canada are squatters. Plain and simple! The

indigenous people have the same rights under international law as

anyone else, whether a country chooses to acknowledge it or not,

as in South Africa. Our vast tracts of land, which have been cared

for by our ancestors, continue to be ours despite the delusional

fraudulent claims of the colonizing states.



Treaties concluded through bribery and with colonial puppets,

instead of with valid representatives of our people, are not legal.

It should be borne in mind that most, not all, of the treaties ever

made with the colonizers granted them only very limited rights

that fall far short of the greedy advantages they imagined. They

had no intention of ever living up to any treaty. They were hell

bent on stealing everything. The U.S. and Canada came as

profiteers and fraudulently tried to steal all our assets.



Such documents were concocted in clear violation of international

law then and now. This requires the informed consent of the people

concerned. No state can incorporate another unless a clear majority

of the people has expressed consent through fairly conducted

democratic processes based on a clear question.



The Six Nations Confederacy and the Algonquins are the title

holders of most of the eastern half of what is known as the colonies

of Canada and northeastern U.S. Our Indigenous laws prohibit

alienation of our lands. We hold them as trustees for the coming

unborn generations. We refuse to surrender our lands. The

implementation of the Indian Act and federal Indian law is genocidal.



According to article VI of the U.S. Constitution, treaties represent the

Supreme Law of the Land binding each party to an inviolable

international relationship. Those without treaties with the colonists

hold their lands independent and free. The only legal authority is

Indigenous. Article II sets out the primary nation-to-nation relationship.

In Canada Section 109 of the British North America Act 1867 respects

the primary authority of the Indigenous peoples.



The U.S. and Canada have violated the independent Indigenous

Peoples by “clerical” action, edicts and pronouncements violating

our international treaty rights and authority.



The Lakota declaration of withdrawal from the Treaty of Laramie 1868

is vested in the power of the Lakota people and the children. One

individual does not represent the nation. The nation represents the

individual. The withdrawal is for the people, elders, mothers, fathers

and children including the unborn faces beneath the ground.



The Treaty of Laramie was never honored. It’s been a colonial

catastrophe, which was not its intent on our part. Indigenous children

are still being taken away putting them out of balance from learning

the traditional life ways. The true way is to be free and left to govern

and look after our own with the teachings of the animal nations. This

is about the Lakota Nation and the Animal People who are no longer

here. “We are the Lakota Nation of Nebraska, North Dakota, South Dakota,

Wyoming and Montana”. We are alerting the Family of Nations of our

action with the backing of Indigenous, international and U.S. law.



Should all Indigenous nations of Onowaregeh, Turtle Island, assert our

freedom and independence, what would happen? The action of the

“Lakota” is going to have repercussions far and wide.



The colonists would go out of business, especially the oligarchs. They

would have to work out agreements with all the Indigenous people on

whose land they are squatting. Indigenous “liens” on buildings,

development, resource extraction and all activities on our land will have

to be governed and executed by us. Each Indigenous nation will assert

our power over our lands, assets and resources. The colonies of U.S.

and Canada will just have to become law abiding. They will have to learn

to respect indigenous and international law. This will not bring a

catastrophe for the ordinary people living on our land. They just have to

come to terms with the reality that they are living within our jurisdiction,

that they are visitors on our land and that they are required to follow our

law.



The pointlessness of their former reliance on their handpicked “Indian”

puppets set up by the colonial Indian Act band councils and federal

Indian law tribal councils will become obvious. These sell-outs will have

to live amongst their relatives without colonial power and support.

Whisky, money and guns will lose their mystical attraction.



The Lakota call upon the world to support this struggle for sovereignty

and treaty rights. They pledge their assistance to all sovereign people

who seek their independence.



The Lakota have invited those living on their lands to join them. Lakota

will issue permits to them, passports, driver’s licenses and other

documents. Living there would be tax free providing the residents

renounce their U.S. citizenship.



The Lakotah are to open negotiations with the State Department of the

U.S. government to establish diplomatic relations. They are setting up

offices in Washington and New York City.



Are we going to see the other nations of Turtle Island asserting

sovereignty? Don’t let those “dirty rotten lawyers” meddle or intervene.

They’re not the ones who decide what the law is. The law belongs to the

people. As our ancestors told us, “One nation will take the issue so far.

Then another will take it further. Until we all regain everything that is ours”.

So who’s next?

It should be noted that although this looks good on the surface the real battle has just begun as the Lakota's will eventually have to make their own currency as use is contractual and binding upon the benefiting parties...The banks too will play a part as the lack of a corporate body to deal with creates a problem as to not be registered with the US or be another other recognized foreign nation needs just that...recognition.....keep them in the commerce game so they can apply for loans based upon their lands resources and future yields..offer them membership at the UN another fiction...just what the Lakota are attempting to depart from....

I hope my brothers and sisters who can forsee this happening will contact those brave souls in skins to warn them so as to create their own international value based currency...

If the Lakota do not their conquest is only delayed.....International Banking law allows them to receive Billions in credit for a start up Nation. Bretton Woods Act,,,,

Wonder if they will find 10's of Billions as enticing

Greetings everyone, I think of you all often. These past months have been spent wandering through this land and I will probably continue to do that until I find where it is that I'm supposed to be.

Ghostchild, if I understand it right, the money allegedly being held in trust for the people these many past years has been and continues to be withheld from those to whom it is owed and is daily squandered on foreign wars just like those that were designed to anhilate the people of Turtle Island. All these self defined"stewards" know is war and that doesn't involve paying off their debts to the people they tried to destroy.

Knowing the money is owed is, in effect, like winning a judgement ... You may have it in writing, but it can't be enforced and judgements, like promises, aren't edible. Its all on paper, just like the treaties.

Hi BearCub, its so good to hear from you.

I read the first link, but the second one locked up for some reason. I agree with what was said in the first, except that it won't happen because its THEIR money we're talking about. That's the problem, we're forever at a disadvantage whether we're the payer or the payee because they get us from both directions. That was always the plan and it works perfectly, for them. I would dearly love to be wrong about this, but I just don't see how supplications or demands will ever make those who are evil to the bone act honorably.

I've long since given up on the idea that our economic dealings, even with each other, could miraculously become honest and equitable for the simple reason that all of the currency we have to deal with is contaminated by greed before its ever even printed ... keeping in mind that most of the debt that the governments and we, ourselves, create by applying for more and more credit from the international bankers is never printed at all. This was always a plan to bankrupt the people and steal their land and resources, making us all slaves to them in the process and it certainly has done that, in spades. So how can we rid ourselves of this rapacious usury debt system and create open and honest instruments of commerce when we're all just so anxious to get more of their contamination into our hands? Yeah, I know, we've got to have it to live ... and guess who knows that.

But would we really need it if we put our noggins together and created our own economic system(s)? Hemp paper and a little ink. That should just about do it as long as those we choose to do business with honors the value it represents. And if they won't do that, are they the only provider of the goods/services we'd need? If so, its just a new enterprise crying to be started up. Just about every country in the world is dumping dollars right now and some are creating their own money ... will we be the last to get on that bandwagon?

So my main question is this: how could an open and honest economic system be created short of a complete, orderly and peaceful secession from all of the corrupt institutions and governing bodies that we currently bow down to?

Notice to All Foreign Governments and Private Owners of Real Estate within the Republic of Lakotah.



TO:

The United States of America;

The States of: Montana, Wyoming, North Dakota, South Dakota and Nebraska;

The County and Municipal Governments Operating within the Republic of Lakotah; and All Private Owners of Real Estate within the Republic of Lakotah

Lakotah, through its government, have appointed representatives to withdraw from all the treaties with the United States of America.

Lakotah, through such representatives, have formally withdrawn from all agreements and treaties with the United States of America. The reinstitution of our freedom and independence is found in law.

Lakotah has reclaimed sovereignty as a nation and over its traditional lands.

Despite many years of repeated bad faith on the part of the United States government towards the Lakotah People, the Lakotah hold no animosity toward the American people, most of whom have had no part in the actions of their government. We wish to deal with the American people in good faith and in a win-win manner.

While we have the right to impose liens on all of the real estate in our country, we prefer to come to resolutions with you all with out resorting to such measures. Accordingly, at this time, we are only declaring liens on real estate held by governments foreign to the Republic of Lakotah, but not on real estate held by private parties.


The Declaration of Independence, the Constitution of the United States of America and the Vienna Convention on the Law of Treaties substantiate this freedom.



Lakotah welcomes the opportunity to meet and discuss this matter. We are in the process of scheduling meetings and will issue public invitations. Should you desire input with regard to scheduling these meetings, please contact us at the above.

As for an "h" at the end of Lakota, Dakota and Nakota, I think the names were simply shortened in popular terminology at some point in time, but many of the siouan people have always used it.

Legitimacy of 'Republic of Lakotah' questioned

ROSEBUD, S.D. - Tribal leaders in the northern Great Plains said that actor and activist Russell Means has accurately portrayed the federal government's broken promises to America's indigenous peoples. But when Means and a group of fellow activists recently announced a Lakota withdrawal from all treaties with the U.S. government, they were not representing the Lakota and other Sioux tribes of the area, the leaders said.

Means and a delegation calling themselves the Lakota Freedom Delegation convened a press conference Dec. 19 at the Plymouth Congregational Church in Washington, D.C., where the withdrawal was declared. A seven-page document titled ''Lakotah Unilateral Withdrawal from All Agreements and Treaties with the United States of America'' was presented to the U.S. State Department, according to the group's Web site at www.republicoflakotah.com.

Rodney Bordeaux, president of the Rosebud Sioux Tribe, said Russell's group was not authorized to speak on the tribe's behalf: ''They're individuals acting on their own. They did not come to the Rosebud Sioux tribal council or our government in any way to get our support and we do not support what they've done.''

The Rosebud Sioux have around 25,000 enrolled members with between 15,000 and 20,000 people living on or near its 900,000 acres of trust land, Bordeaux said. The tribe's reservation once comprised of 3.2 million acres, but the land was expropriated through the Homestead Act, the Allotment Act and other ''legal'' mechanisms that successfully robbed indigenous peoples of their lands. The Sioux tribes are spread over South Dakota, North Dakota, Minnesota, and parts of Nebraska and Wyoming.

''That's all our treaty lands,'' Bordeaux said. ''Russell made some good points. All of the treaties have not been lived up to by the federal government, but the treaties are the basis for our relationship with the federal government and also the basis for the trust relationship to our lands. We're trying to recover the lands that were wrongfully taken from us, so we are going by the treaties. We need to uphold them.

''We do not support what Means and his group are doing and they don't have any support from any tribal government I know of. They don't speak for us.''

In a phone interview with Indian Country Today, Means made clear his thoughts on the tribal leaders of the Sioux nations.

''I maintained from the get-go I do not represent, nor do the free-thinking, free-seeking Lakota want to have anything to do with, the 'hang around the fort' Indians, those collaborators with the government who perpetuate our poverty, misery and our sickness - in other words, our genocide. They are part and parcel of that genocide. I couldn't care less what the bought-and-paid-for, 'hang around the fort' Indians represent or what they say. End of conversation,'' Means said.

He further noted that his group has liberated the land and established the ''Republic of Lakotah,'' which he said has been done legally according to Article 6 of the U.S. Constitution, the Vienna Convention on the Law of Treaties and the U.N. Declaration on the Rights of Indigenous Peoples. The republic is currently governed by a ''provisional government.''

The provisional government plan is negotiating with ''foreign investors'' to develop the energy resources on the land.

''There's enough wind coming from North and South Dakota to power electricity in every city in the U.S. forever; so, consequently, we are now in negotiations with investors who are going to want to immediately put up windmills and solar because the sun shines on the Lakota in the northern Plains over 300 days of the year,'' Means said.

He declined to name the potential investors until the deal is completed, but said the group has land that it will utilize.

He said the Republic of Lakotah would have a gold-based economy, that it had already established a bank and would use the ''economic weapon or tool'' of property liens to force the federal government to come to the negotiating table.

But what does the republic want to negotiate?

''We want them to have hands off, to realize that our relationship is diplomatic,'' Means said.

Means said the republic tried to files liens against property the South Dakota state government had seized for nonpayment of taxes, but the county in which the attempt was made refused to accept them because it didn't know what a sovereign nation was.

Asked how the republic's government had formed, Means said, ''Actually, that's none of your business. I went around and we, the people who are leading this, we got critical mass - enough freedom-seeking Lakotas - to make it worthwhile for us to seek our freedom.''

The group's attempt to withdraw from the treaties on behalf of the Lakota people ''doesn't mean anything,'' said BIA spokesman Gary Garrison.

''These are not legitimate tribal governments elected by the people. These are just groups who don't have a government-to-government relationship with the federal government,'' he said, adding that ''the group's claim to be acting according to the law is their interpretation.''

''It's not like we haven't had individual groups that have declared independence from the federal government all the way from Montana to Texas; and as long as they want to go out and sit on a hill and play paramilitary and be independent, that's fine. That's every American's right.

''But the bottom line is when they begin the process of violating other people's rights, breaking the law, they're going to end up like all the other groups that have declared themselves independent - usually getting arrested and being put in jail,'' Garrison said.

Means and his group are not saying anything new, said Joseph Brings Plenty, chairman of the Cheyenne River Sioux Tribe.

''What has been said by these individuals has been talked about from dinner table to dinner table since I was a young kid; but the thing is, these individuals are not representative of the nation I represent. I may agree, I may disagree, but they have not gone out and received the blessing of the people they say they are speaking for,'' Brings Plenty said.

But, he added, the ''facts are the facts. Unless a person lived here, you couldn't see the day-to-day, the way we live and how our lifestyle has been lowered. ... The document they took [to Washington] referred to what the U.S. government has failed to do in the treaties. Our funds have been cut and it's been crisis management from year to year. There's always a justification as to why the funds and obligations of the treaties aren't being met. There's no justification from our tribes' point of view. Maybe not enough people understand what happened to our relatives,'' referring to David Stannard's 1992 book, ''American Holocaust.''

Perhaps the group's actions have value in raising awareness of the real history?

''That's what it is. I think raising awareness is a big part of what's happened with the tribes: past, present and what sort of future we're looking at,'' Brings Plenty said.
